idprove.app (the ‘Website’) is created and designed to make it simple for you to provide documents direct to your law firm, to help them identify you for a property transaction.
The Website helps your law firm comply with the requirements of Australian Registrars National Electronic Conveyancing Council’s Model Participation Rules (the `ARNECC Rules`).
The Website does not provide you with any legal advice itself. Nor does the website act as your legal agent for the property transaction.
The Website is operated by IDPROVE PTY LTD ABN 34658717072 ('IdProve P/L').
These terms and conditions may be reviewed, and changed, from time to time by IdProve P/L.
By using the Website, you confirm that you have read, understood and agreed to be bound by the terms and conditions described here.
As described above, the Website does not mean that IdProve P/L acts as your agent. Without limiting the generality of this statement, IdProve P/L does not act as your `Identity Agent` as that phrase is used in the ARNECC Rules.
The Website acts merely to collect information, and makes no guarantee or warranty or statement of the accuracy of the information gathered.
IdProve P/L does not give any warranty or make any statement that the information gathered satisfies any of the requiremnets of the ARNECC Rules.
You warrant that any information provided by you while using the Website is accurate, correct and up to date.
You will not use the Website for any illegal and/or unauthorised use.

Price / Refunds

At any time up to the point of payment, you can cease using the Website, and there will be no fee.
Until payment is made, the information and documents you provide will not be forwarded to your law firm.
You will not be requested to pay a credit card payment until you have completed the steps that will mean that you have completed all of the services being provided.
The fees payable by you for using the Website are described at the beginning (first page) of this website.
The fees must be paid by credit card, before the information is provided to your lawyers.
Once payment is made, the information and documents you have provided will be forwarded to your law firm, and at that time it will not be possible to cancel the service or request a refund (because at that time the whole of the service will have been provided).
You agree, before you make payment, that you have completed the documents and information correctly, and that you are satisfied and wish to finalise the services being provided.

Privacy

The Website is designed to have "single use" URLs ... which means you will be provided with a URL which can be used only once.
The Website uses the Secure Socket Layer security protocol, which means that it highly improbable that information provided by you through the Website, can be intercepted by a malicious third party. Even so, we recommend that you use the Website on your mobile phone only, and do not make use of any publicly shared wifi while using the Website.
You must make sure that the device you use to access the Website is not exposed to viruses, malicious code or other forms of interference. For this reason, we recommend that access to the Website be only on your mobile phone. We do not accept responsibility for any interference or damage to property which arises in connection with use of the Website.
Information received will be encoded and stored in an encrypted format, on an Amazon S3 service. Upon payment for the services, the information will be forwarded to your law firm in encrypted format, for your law firm's access only. The information will not be retained or accessible by IdProve P/L.

Limitation of Liability

You acknowledge and agree that:

The Website cannot be guaranteed to be error-free, and the existence of any such errors will not constitute a breach of these Terms and Conditions.
You use the Website at your own risk.
Except as expressly provided to the contrary in these Terms and Conditions , and to the full extent permitted by applicable law, we will not be liable for any loss, including special, indirect or consequential damages, or claim, arising directly or indirectly from: the supply of a defective service; a failure to provide the service or any part thereof; errors or interruptions occurring in the course of using, or as part of, the Website; corruptions to or loss of data in connection with the Website; any suspension or discontinuance of the Website; a breach of these Terms and Conditions.
You may have rights under the Australian Consumer Law, including the Consumer Guarantees, which cannot lawfully be excluded and nothing in these Terms and Conditions has the effect of excluding, restricting or modifying such rights and Consumer Guarantees. Where the law implies a warranty into these Terms and Conditions which may not lawfully be excluded (in particular warranties under Australian Consumer Law) the liability of IdProve P/L for breach of such a warranty will be limited to, if applicable, either supplying the services again or payment of the cost of having the services supplied again.
You acknowledge that you have exercised your independent judgment in using the Website and have not relied on any representation that IdProve P/L has made which has not been stated expressly in these Terms and Conditions.

You agree to indemnify and hold IdProve P/L harmless against all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your use of the Website, whether direct or indirect, and irrespective of cause.
